Terms & Conditions
Bug Art Limited ('Bug Art') gives you ('the Customer') access to the Bug Art website ('Website') and sells our greeting cards and other products ('Products') to you subject to the terms and conditions set out below. By buying our Products you agree to accept these terms and conditions.
1. Purchase Agreement
Once you have purchased the Products from our Website, we shall send you an email containing the details of your order and payment. Only when we have despatched the order and confirmed this by email, shall we have legally accepted your order and entered into a contract between us. Should there be any Products on your order that have not been despatched, these Products do not form part of the agreement.
2. Returns & Statutory Rights
You are entitled to a seven day cooling- off period, during which time you can
return the Products to us. Once we have received them, we shall refund the cost
of the Products but not the cost of returning them. To ensure that we do receive
them, please use a method where both delivery and signature are recorded. Should
we not receive the Products, we cannot refund your money.
We shall only make a full refund if the Products are returned to us in perfect condition. The cellophane bag inside which each card and envelope is packed must remain unopened. If the bag has been opened the cost of repackaging will be deducted from the refund.
3. Returning Defective Products
We aim to despatch the Products in perfect condition. Occasionally, however, the Products can arrive at their destination in a damaged or defective condition. If this is the case with your delivery, please return the defective Products to us within seven days of receiving them. We shall then either replace the defective Products and reimburse the postage cost of returning them, or reimburse both the cost of the defective Products and the postage cost of returning them.
All orders under £40 will be posted to you Royal Mail first class. Orders over £40 will be sent first class recorded delivery and will need to be signed for as proof of delivery.
We sell and deliver to UK addresses only.
All prices are inclusive of VAT at the prevailing rate and postage costs.
6. Minimum Order ValueThe minimum order value is £15, including VAT and postage costs.
From time to time Products may be temporarily unavailable. In the event of this
being a short term occurrence, we shall delay the delivery until the Products
have been sourced. In the event of the delay being more than a week, we shall
contact you for a substitution, either by email or telephone. If we are unable
to contact you or receive no reply, we shall after another week cancel the order
and confirm this by email.
We shall not split the delivery for any reason.
8. Health & Safety
Cards in the Snout range have plastic eyes and noses which may become detached. These cards are not suitable for small children and Bug Art will not be liable for any injury caused by any of these plastic components.
We do not sell Products to children or anyone under the age of 18.
10. Product Description
Images on the Website are taken from the original artwork. The description for
each range includes the processes used to enhance the image – foil, emboss,
flitter etc. These finishes do not show on the Website image. By placing the order
you have accepted that this is the case.
Colour quality on computer screens varies – you may find when the product arrives that the colour differs from that on your screen. By placing the order you have accepted that this is the case.
11. Liability for Loss
Bug Art will be responsible for any losses you suffer as a result of us breaching any of the Terms and Conditions only if the losses were reasonably foreseeable when the contract was formed between us. We shall not be responsible for any commercial or business loss - including loss of revenue, profit, data, or goodwill, or any other indirect or consequential loss that is not reasonably foreseeable when the contract was formed between us. Bug Art does not attempt to limit in any way any liability by law for death or personal injury caused by our negligence, breach of duty, gross negligence or wilful misconduct.
We reserve the right at any time to make changes to our Website, policies, and
these Terms and Conditions. You will be subject to the Terms and Conditions published
at the time you order Products from this Website, other than when further changes
are required by law. If any of these conditions is deemed void or for any reason
unenforceable, that condition will be deemed severable and will not affect the
validity and enforceability of any remaining conditions or the contract between
We shall not be held responsible for any breach of our obligations under these terms and conditions if the breach arises for any reason beyond our reasonable control.
The Website content, including text, graphics, logos, button icons, images, page
layouts and software, is the property of Bug Art and is protected by United Kingdom
and international copyright and database protection laws.
You may not extract to re-use any part of the Website without Bug Art's express written consent.
These terms and conditions are governed by the laws of England and Wales and will be subject to the non-exclusive jurisdiction of the English courts.
15. Privacy and Security Policy
We are committed to protecting your privacy. We will only use the information that we collect about you in accordance with the Data Protection Act 1998.
* What we will do with your contact information
Bug Art will not sell or pass your name, address or email address to any third party unless legally obliged to by UK Government authorities.
* Direct marketing
When you register on the site you will be given the opportunity to ‘opt in’ to receive marketing emails from us. You can choose to change this preference at any time.
* Encryption of personal Information
We offer the use of a secure server. All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Payment gateway providers database only to be accessible by those authorised with special access rights to such systems, and who are required to keep the information confidential. Our Customer Service staff have no access to this information.
* Encryption of passwords
We appreciate that many people use the same password for all their internet accounts and therefore this information is very sensitive. For this reason your password remains encrypted and we do not have access to it. If you have forgotten your password we can send you a new temporary password. You are then able to access your account and change the password to something which you will remember.
* Credit card transactions
Your card details are transferred directly to our Payment Service Provider (www.cardsave.net) for immediate authorisation and are not recorded or stored in our database. Once we have received authorisation from the Payment Service Provider we confirm your order.
